K-1 VISA
Global Allianz Law Firm LLP possesses the expertise required to handle your immigration application for the K-1 visa.
A K-1 visa is a dual intent visa specifically issued to the fiancé or fiancée of a United States citizen, facilitating entry into the United States. The key requirement of a K-1 visa is for the foreigner to marry their US citizen petitioner within 90 days of entry. Subsequently, upon marriage, the foreign citizen can adjust their status, becoming a lawful permanent resident of the United States, commonly referred to as a Green Cardholder. If a K-1 visa holder fails to marry their US citizen petitioner within the stipulated 90 days, they are obligated to depart the United States within 30 days.
US citizens planning to marry a foreign national in the United States can initiate the process by filing a petition for a fiancé (e) classification (K-1) on behalf of their intended spouse. Essential eligibility criteria include the requirement that both the US citizen and the fiancé (e) must be free to marry, signifying that they are unmarried and that any previous marriages have concluded through divorce, annulment, or death.
Global Allianz Law Firm LLP is committed to leveraging its expertise to navigate the intricacies of the K-1 visa application process, ensuring a smooth and successful immigration journey for its clients.
Overview of the K-1 Fiancé(e) Visa Process:
- Petition Filing: The US citizen initiates the process by filing a Petition for Alien Fiancé (e) (Form I-129F) with the US Citizenship and Immigration Services (USCIS) office serving their region.
- USCIS Approval: Upon USCIS approval of the petition, the US embassy or consulate in the foreign fiancé (e)’s residing country is notified.
- Visa Application: The foreign fiancé (e) applies for a K-1 visa at the designated US embassy or consulate in their home country. This involves providing additional documentation, undergoing a medical exam, and attending a visa interview.
- Entry to the US: Once the K-1 visa is granted, the fiancé (e) enters the United States with K-1 visa status and is required to marry the US citizen within 90 days.
- Change of Status: Following marriage, the K-1 visa holder initiates a change of status by applying for legal permanent residency, commonly known as obtaining a “green card.”
