The H-2B visa is available to employers of foreign workers not working in the agricultural field. This visa is only available for work that is temporary in nature. The H-2B working visa is a non-immigrant visa which allows foreign nationals to enter into the U.S. temporarily and engage in non-agricultural employment which is seasonal, intermittent, a peak load need, or a one-time occurrence.
THIS VISA IS SUITABLE FOR THE FOLLOWING:-
- Foreign athletes, trainers or artists with a job offer from a U.S. employer.
- Skilled workers in raft and traders who are able to perform tasks for which no U.S. workers are available.
U.S. companies hiring foreign nationals to perform temporary work for which no U.S. workers are available.
REQUIREMENTS OF H-2B VISA
An H-2B non-agricultural temporary worker is an alien who is coming temporarily to the United States to perform temporary services or labor, is not displacing United States workers capable of performing such services or labor, and whose employment is not adversely affecting the wages and working conditions of United States workers.
H2B Visa Entitlements
An H-2B visa entitles the holder to live and work in the US temporarily. An H-2B visa is usually granted for an intial period of 1 year and extensions may be granted.
Spouses and unmarried children under 21 years of age may apply for the applicable derivative visa (H4 visa) to join their spouse or parent in the US. Accompanying spouses and children are entitled to study in the United States but are not entitled to undertake any employment without obtaining an appropriate work visa.
