Now you can get a green card and become a permanent resident through your family relationship with a US citizen or a Green card holder. Family members of U.S. Citizens and Green Card holders who wish to immigrate permanently to the U.S. may apply for a green card based on their family relationship.

You can become a PR Card holder in the following manners:-

Category 1: This includes spouses, unmarried children under the age of 21, and parents of U.S. citizen petitioners of the age 21 or older.

Category 2: This includes unmarried sons or daughters over the age of 21, married children of any age, and brothers and sisters of U.S. citizen petitioners 21 or older.

Category 3: This includes spouses and unmarried children of the sponsoring green card holder.

Special Category: This can include battered spouse or child (VAWA), a K non-immigrant, a person born to a foreign diplomat in the United States, a V non-immigrant or a widow(er) of a U.S. Citizen.

S-Visa is Suitable For:- In this category, some certain qualified relatives of a US citizen are allowed to grab Permanent residency in the US. These relatives are provided special priorities regarding the issuance of US Visas. These eligible relatives include a U.S. citizen’s:-

  1. Parent (if the U.S. citizen is over the age of 21).
  2. Spouse.
  3. Unmarried child under the age of 21.

Category 2 If your relationship to a US Citizen is not of the above type, then you fall under the “family preference category”. Limited number of relatives may immigrate under this category each year. These relatives have to wait for their turn to get a Visa. It includes:-

  1. Unmarried sons or daughters over the age of 21.
  2. Married child(ren) of any age.
  3. Brothers and sisters (if the U.S. citizen petitioner is over the age of 21).

Category 3 Just like a US citizen, a permanent resident can file a petition for his/her spouse and unmarried child(ren) of any age to immigrate to the United States. Relatives of Green Card holders:-

  1. Spouse.
  2. Unmarried child (under the age of 21).
  3. Unmarried stepchild (under the age of 21).
  4. Adopted child (under the age of 18), or
  5. Unmarried son or daughter (over the age of 21).

Category 4 One can get a green card through some special specified family situation. These are very limited. These include:-

  1. Battered Spouse or Child (VAWA).
  2. K Non-immigrant (includes fiancé(e)).
  3. Person Born to a Foreign Diplomat in the United States.
  4. V Non-immigrant.
  5. Widow(er) of a U.S. Citizen.
