“EB-5,” was created by Congress to generate job creation and capital investment opportunities by foreign investors in the U.S. economy.EB-5 visas are set aside for investors in Regional Centers designated by USCIS based on proposals for promoting economic growth.
All EB-5 investors must invest in a new commercial enetrprise which is established after Nov. 29, 1990, or established on or before Nov. 29, 1990, that is:
1. a new commercial is formed which is either restructured or reorganised, or
2. an existing organisation is Expanded through the investment so that the net worth increases uo to 40-percent or number of employees.
Commercial enterprise is any ongoing business lawfully run for profit making, but not limited to:
- A sole proprietorship.
- Partnership (whether limited or general).
- Holding company.
- Joint venture.
- Corporation.
- Business trust or other entity, which may be publicly or privately owned.
